Terms of Use

StayNiska is a guest-facing online travel platform (OTA) that enables travellers to search, compare, and book hotel stays including hourly day-use, short stays, overnight, and multi-night reservations, as well as curated holiday packages. StayNiska also provides an AI-assisted travel concierge to help with trip planning and booking guidance.

StayNiska acts as an agent connecting guests with independent accommodation providers. The contract for each accommodation is between the guest and the property; StayNiska facilitates, confirms, and supports that booking but is not itself the accommodation provider.

To use StayNiska you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Provide accurate, current, and complete information during registration and checkout.
• Not be prohibited from using our services under applicable law.

If you are making a booking on behalf of others, you confirm that all guest details you provide are accurate and that the other guests have consented to their data being shared with us as described in our Privacy Policy.

• You are responsible for keeping your account credentials confidential. Do not share your password with others.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at hello@niskagroup.com if you suspect unauthorised access to your account.
• You may close your account at any time using the Delete account page.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraud, or pose a risk to other users or properties.

Making a booking

When you complete checkout and receive a booking confirmation, you are entering into a binding reservation contract with the accommodation property. Rates and availability are subject to change until payment is successfully processed and a confirmation number is issued.

Pricing

All prices displayed include applicable taxes and fees unless clearly marked otherwise. Prices are typically displayed in Indian Rupees (INR) for Indian properties; international properties may display in local currency. Currency conversions are indicative and the final charge will be in the currency shown at checkout.

Hourly & day-use stays

Where a property offers hourly inventory, you may book for a specified number of hours during the day. The minimum and maximum duration, check-in times, and pricing are set by the property and shown at checkout. Hourly bookings cannot typically be extended on-property without a new reservation.

Guest responsibilities

• Guests must present valid government-issued photo identification at check-in as required by the property and applicable law.
• You are responsible for complying with all property-specific house rules, check-in/check-out times, and local regulations.
• Any damage caused to the property during your stay remains your personal liability.

• Payments are processed by our PCI-DSS certified payment partners (currently Razorpay and ResAvenue). We do not store full card numbers.
• By providing payment details, you authorise us to charge the total amount shown at checkout, including all taxes and service fees.
• For properties offering "Pay at Hotel" or "Pay Later" options, your payment card may be used for authorisation or guarantee purposes even if charged later.
• If a payment fails after a booking is placed, we will notify you and the reservation may be automatically cancelled.

Cancellation and refund terms depend on the rate type you selected at checkout (Flexible, Moderate, Strict, or Non-Refundable). The specific policy applicable to your booking is displayed before you confirm payment and in your booking confirmation email.

StayNiska includes an AI-assisted travel concierge ("Concierge") to help you discover stays, plan itineraries, and answer travel-related questions. Please note:

• Concierge responses are generated by AI and may not always be accurate. Always verify critical information (pricing, availability, property policies) through the official booking flow before making decisions.
• Conversations with the Concierge are stored as described in our Privacy Policy and used to improve the service.
• Do not share sensitive personal, financial, or medical information with the Concierge beyond what is needed to complete a booking.
• In preview or beta environments, some Concierge responses may be simulated.

You must not use StayNiska to:

• Make fraudulent, speculative, or false bookings, or bookings you have no intention of fulfilling.
• Scrape, crawl, or systematically extract data from StayNiska without our written permission.
• Reverse engineer, disassemble, or attempt to derive the source code of any StayNiska software.
• Transmit viruses, malware, or any code designed to disrupt or damage our systems or those of our partners.
• Harass, defame, or harm any property, employee, or other user of StayNiska.
• Resell or sublicense access to StayNiska or use it to operate a competing booking service without written consent.
• Violate any applicable local, state, national, or international law or regulation.

All content on StayNiska — including the StayNiska and NISKA brand marks, destination guides, software, design, and documentation — is the property of NISKA INNOVATIONS LLC or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use StayNiska for personal, non-commercial booking purposes only. Nothing in these Terms transfers any intellectual property right to you.

• StayNiska is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
• Property descriptions, images, amenities, and ratings on StayNiska are provided by or sourced from accommodation providers. We do not independently verify all property information and cannot guarantee its accuracy.
• AI Concierge responses are informational only and do not constitute professional travel, legal, or medical advice.

To the fullest extent permitted by applicable law, NISKA INNOVATIONS LLC and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, consequential, special, or punitive damages arising out of your use of or inability to use StayNiska.
• The acts, omissions, or quality of any accommodation property, including cancellations, overbookings, or property-standard disputes.
• Force majeure events including natural disasters, government actions, pandemics, or infrastructure outages.

Our total aggregate liability for any claim arising from these Terms or your use of StayNiska will not exceed the amount you paid to StayNiska for the specific booking giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless NISKA INNOVATIONS LLC, its officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of StayNiska, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions.

For users in India, disputes relating to consumer protection may also be addressed through the applicable Indian consumer dispute resolution forums in accordance with the Consumer Protection Act, 2019.

Before initiating formal proceedings, we encourage you to contact us at hello@niskagroup.com to resolve any dispute informally. We aim to respond and propose a resolution within 14 business days.

We may revise these Terms from time to time. Material changes will be communicated by email (where you have an account) and via a notice on the StayNiska website at least 14 days before they take effect. Continued use of StayNiska after the effective date constitutes acceptance of the revised Terms.
